Welcome to VirtualAgentOS ("The Platform"), the premier Enterprise AI Automation and Virtual Workforce management system. The Platform is owned and operated by Benjamin CFO App, a Florida-based Technology Trust ("The Company").

Our ecosystem integrates with CebuVA (Community of Entrepreneurs Building Unlimited Value & Abundance), a virtual accelerator and academy that provides trained human operators ("VAOS Operators") to manage your AI workflows.

By accessing our SaaS (Software as a Service) tools, AI Agents, or engaging with our Virtual Academy, you agree to these Terms.

2. Data Privacy & Security

We take your data sovereignty seriously. Our system utilizes Tier-1 Cloud Infrastructure to ensure compliance with global standards.

  • Information We Collect: We collect business identity data, contact information, and payment details to facilitate your AI Automation Agency operations.

  • AI Data Processing: To power our Agentic AI tools, user inputs (such as chat logs and workflow configurations) may be processed by our LLM (Large Language Model) partners. We do not sell this data to third-party data brokers.

  • Human-in-the-Loop: If you utilize CebuVA talent, you acknowledge that authorized VAOS Operators may access your sub-account to perform assigned tasks. All operators are bound by strict non-disclosure agreements (NDAs).

3. Payment Terms & Card-on-File Authorization

All financial transactions are processed securely via Stripe. We do not store full credit card numbers on our servers.

By providing your payment method, you explicitly authorize Benjamin CFO App to:

  1. Store your card on file for future transactions.

  2. Charge Recurring Subscription Fees (e.g., Monthly or Annual SaaS Access).

  3. Charge Variable Usage Fees ("Tech Usage") for telephony, SMS, Email, and AI Token Consumption at our current platform rates.

  4. Charge for authorized add-ons, High-Ticket snapshots, or Academy upgrades.

4. Refund Policy, Cancellation & Sustainability

Our Ecosystem Philosophy: VirtualAgentOS and CebuVA operate on a model of Shared Sustainability. Because we invest heavily upfront in building your custom AI systems and training dedicated human talent, we maintain a selective application process. We only partner with businesses prepared for this commitment to protect the livelihoods of our global workforce.

A. Month-to-Month Plans

  • No Refunds: Payments are non-refundable once processed.

  • Cancellation: You may cancel your month-to-month subscription at any time via your account portal.

  • Access: Upon cancellation, your service and data access will continue until the end of your current paid billing cycle. No further charges will be applied.

B. Fixed-Term Commitments (6, 12, or 60 Months)

  • Binding Agreement: Plans with a defined term are binding contracts designed to secure long-term talent and server resources.

  • Strict No-Refund Policy: We do not offer refunds for unused time, "change of mind," or under-utilization of the platform.

C. Hardship & Early Termination (Buyout Option)

We understand that considerable financial hardships can occur.

  • Case-by-Case Basis: In extreme circumstances, The Company may, at its sole discretion, approve a request for early contract termination.

  • The Buyout Fee: If approved, you may terminate the remainder of your contract by paying a Break Fee equal to 50% of the remaining contract value.

  • Example: If you have $2,000 remaining on your term, you may buy out the contract for a one-time payment of $1,000. This fee covers the decommissioning of assets and transition costs for the assigned workforce.

5. Usage-Based Billing Disclosure

VirtualAgentOS is an Enterprise SaaS platform that incurs real-time costs for telecommunications and Generative AI processing.

  • Wallet System: Users must maintain a positive wallet balance to send SMS, emails, or utilize AI Employees.

  • Rebilling: The Company reserves the right to rebill these services at a margin to cover operational overhead and platform maintenance.

6. Liability & Earnings Disclaimer

VirtualAgentOS provides the Tech Stack and Operational Framework for business scaling.

  • No Income Guarantees: We do not guarantee any specific financial results. Your success depends on your market, offer, and execution.

  • Limitation of Liability: To the maximum extent permitted by Florida law, Benjamin CFO App shall not be liable for any indirect, incidental, or consequential damages arising from the use of our AI Tools or Virtual Staffing services.
